Rudolf von Jhering (1818–1892) gehört zu den großen deutschen Rechtsgelehrten mit internationalem Rang. Es gibt auch keinen zweiten Rechtsgelehrten, der in der Mitte seines wissenschaftlichen Lebens die Zäsur seiner rechtsmethodologischen Auffassungen öffentlich so effektvoll zelebriert hätte wie Jhering. Bis heute ist offen, ob und inwieweit er damit der berufene Interpret seiner eigenen früheren Auffassungen war. Die vorliegende Untersuchung nimmt das zum Anlass, um auf Grundlage veröffentlichter und unveröffentlichter Schriften, Briefe und Nachlassdokumente Jherings der Frage nach Kontinuität und Wandel seiner Auffassungen zum Begriff des Rechts und zur Methode der Rechtswissenschaften im zeitgenössischen Kontext von Pandektistik und wissenschaftstheoretischer Diskussion nachzugehen. Rudolf von Jhering (1818–1892) is one of the most popular German legal scholars of international renown. There has been no other legal scholar who tremendously and publicly celebrated the breach of his legal conceptions in the middle of his scientific career. Until today, it is unclear how and how far he has been the called interpreter of his own early conceptions. For this reason, the present work analyses published and unpublished writings, letters and posthumous documents in order to examine continuity and change of his conceptions on the notion of law and juristic methods in the contemporary context of pandectism and theoretical discussions.
About the author
Prof. Dr. Christoph-Eric Mecke lehrt Rechtsvergleichung, Rechtsgeschichte und Rechtsphilosophie an der Juristischen Fakultät der Universität Zielona Góra in Polen. Zuvor war er wissenschaftlicher Mitarbeiter an der Brunswick European Law School der Ostfalia Hochschule in Wolfenbüttel und Lehrbeauftragter an der Leibniz Universität Hannover. In Passau, Tours und Göttingen studierte er Rechtswissenschaften, Geschichte und Soziologie. Außerdem war er Stipendiat der Niedersächsischen Graduiertenförderung und wurde an der Universität Göttingen promoviert.
