Sie leitet diese Ergebnisse methodisch aus einem "Streitgespräch der Gerichte" zwischen EuGH, EGMR, deutschem BVerfG, italienischem Corte Constituzionale und irischem Supreme Court her. Damit wird erstmals ein Konzept vorgelegt, das der Formel der „gemeinsamen Verfassungstraditionen der Mitgliedstaaten“ aus der Grundrechtsdogmatik des EuGH klare Konturen verleiht. Diese kontextuelle „Auslegungsmethode“ für Unionsgrundrechte weist über die Anwendung am Beispiel des Eigentums hinaus.
