In der Diskussion um religiöse Einrichtungen werden nicht selten Begriffe wie Paralleljustiz oder Fragmentierung der Gesellschaft verwendet. Die Einrichtung eines islamischen Schiedsgerichts, das auf Grundlage des islamischen Rechts rechtsverbindliche Schiedssprüche erlässt, könnte als Widerspruch zu den Grundprinzipien eines säkularen Verfassungsstaates gesehen werden. Die Arbeit soll aufzeigen, wie eine solche Institution im Hinblick auf das nationale Schiedsverfahrensrecht konzipiert sein muss, damit der islamische Schiedsspruch im Einklang mit der nationalen Rechtsordnung stehen kann.
