Das Eherecht der römisch-katholischen Kirche beinhaltet eine Regelung, die es beischlafsunfähigen Menschen verunmöglicht, eine kirchliche Ehe einzugehen. Es tangiert ein Menschenrecht, das dadurch nicht ausgeübt werden kann. Die kirchliche Rechtsordnung wird mit den im staatlichen Recht der Schweiz geltenden Normen konfrontiert, die das Menschenrecht auf Ehe und das Verbot der Diskriminierung aufgrund einer Behinderung enthalten (BV, BehiG, BRK). Kirchenrechtliche und religionsverfassungsrechtliche Lösungsansätze, um die Diskriminierung zu beheben, werden diskutiert.
