Die Juristische Hermeneutik tritt mit dem 20. Jahrhundert in eine entscheidende Phase: Es handelt sich einerseits um den Abschluss einer langen Tradition der juristischen Interpretation, die den Akzent vornehmlich auf den schöpferischen Charakter der Rechtsanwendung gelegt hat. Andererseits ist das 20. Jahrhundert aber auch ein paradigmatischer Neuanfang. Denn gegen die in jener Zeit zunehmend an Einfluss gewinnende analytische Rechtstheorie formiert sich ein »hermeneutischer Widerstand« durch Gustav Radbruch, Arthur Kaufmann und Winfried Hassemer. Der vorliegende, in Italien bereits erschienene Quellenband versammelt hierzu die wichtigsten Texte mit kurzen Einführungen. The beginning of the 20th century marks a crucial point in legal hermeneutics: On the one hand, it concerns the ending of a long tradition of legal interpretation which had mainly focused on the creative character of legal application. On the other hand, the 20th century is a paradigmatic new beginning, since Gustav Radbruch, Arthur Kaufmann and Winfried Hassemer form a "hermeneutical opposition" against the increasingly influential analytic theory of law. The present volume, previously published in Italy assembles the most important writings with short introductions.
